Project Summary: The applicant proposes a 2-lot subdivision of a 3.48 acre parcel located at 31 Commons Way on Friends Point (26.10-1-37). The parcel is located in the TR-1R) Zoning District. The proposed subdivision would create a 1.1 acre parcel (Lot 1) and a 2.48 acre parcel (Lot 2). Both lots will have 100 feet of shoreline. There are two existing cottages on the parcel and after the subdivision, each lot will have one cottage. The parcel is located within Sewer District No. 2. The Planning Board noted limited vegetation on the shoreline and evidence of erosion. Neighbors submitted comments regarding potential wetland on western boundary and drainage way which could be impacted by development. OCTOBER 2010 - The applicant is requesting the subdivision of a 2.38 acre parcel - Lot 1 would be 1.28 acres and Lot 2 would be 1.1 acres and be merged with the adjacent lot (26.10-1-36). Lot 1 will have access to Commons Way.
Waterkeeper Perspective: The Waterkeeper concerns included: the need to construct a separate driveway for Lot 1 when the existing cottage has access through the existing driveway (The Waterkeeper suggested a shared driveway and easement); need to show docks on the site plan to ensure compliant setbacks and need for additional shoreline planting and erosion control protection on the steep bank along the shore.

Next Meeting: The Town of Hague Planning Board reviwed the application at the November 5, 2009 Planning Board meeting, declared a Negative Declaration and approved the 2-lot subdivision with condition: 1) both lots are required to connect to Sewer District No. 2. OCTOBER 2010 - The Town of Hague Planning Board heard the application for the new 2 lot subdivision and accepted the application at their October 7, 2010 Planning Board meeting. The Planning Board scheduled a Public Hearing for November 4, 2010.
DOCKSIDE LANDING MARINA (UPDATED 1/10/11)
Project Summary: The applicant proposes a change in use from a Model Home/Marine Store (log cabin) to a restaurant located at 9130 Lake Shore Road (26.17-2-28). The property is located in the TR-1 Zoning District. A 1983 Planning Board decision for the construction of the building was conditional "That water could not be put in the log home at that time and if the owner desired to put water in the building at a later date, he would have to come before the Board again." In 1999, the owner requested a swapof use for the restaurant to be relocated in the Log House. The ZBA denied the application due to onsite septic issues and parking. The facility is not connected to the Town sewer and additional parking was added this past summer. In 2000, the Planning Board gave their permission to put a ladies room and mens room in for the purpose of marina use. In 2003, the owner went to the ZBA to request an extension of use for a restaurant. It was decided that since a restaurant is an allowable use in the TR-1 district, no extension was needed. A lakeside deck and staricase is proposed. The Lake George Park Commission show the deck in existence on the Dockside marina permit, meaning one did exist when all docks were initially registered. The proposed deck is over water and is in LGPC jurisdiction. The restaurant will be 2 levels with a total seasting capacity (inside and outside) of 98. The applicant is talking to NYSDOT about a crosswalk. NYSDOT sent a January 5, 2011 correspondence supporting the concept of a crosswalk and stating a Highway Work Permit will be required after Town approval. The Lake George Park Commission has stated that a variance will be required for the proposed sundeck for the restatuant.
Waterkeeper Perspective: The Waterkeeper concerns included: construction over the water; improving stormwater treatment on the 100% impervious area of the site and stormwater runoff from the parking lot areas.
Waterkeeper Comments: No formal comments were submitted but it was suggested to the applicant to work with the Waterkeeper. The Waterkeeper provided verbal comments at the November 4, 2010 Planning Board meeting regarding recommendations for the stormwater management system including installing rain gardens along the front of the proposed restaurant, directing rain gutters into planters to function as rain gardens and install pervious pavement as a trench drain in the pavement area.
Next Meeting: The Town of Hague Planning Board reviewed the application at their October 7, 2010 meeting. The Planning Board expressed concerns about: stormwater runoff and treatment; fuel storage and safety; fire code; pedestrian safety and LGPC jurisdiction. The Planning Board tabled the application pending additional information. The Planning Board reviewed the application at the November 4, 2010 Planning Board meeting and scheduled a public hearing for December 2, 2010. At the December 4, 2010 public hearing, concerns were expressed about traffic, pedestrian safety, noise, hours of operation and runoff. The Planning Board held the public hearing open pending feedback from the NYSDOT regarding a crosswalk. The Planning Board listed items of concern for the applicant to address including crosswalk, stairway from parking area, lighting on the exterior of the building, provide an oil-water separator, off-site employee parking, Lake Shore Terrace parking and noise. The application was tabled. The Planning Board closed the public hearing at their January 6, 2011 meeting. The Planning Board stated the major concern with the application was pedestrian access across Route 9N from the parking areas and this concern was address by the NYSDOT letter supporting the concept of a crosswalk. The Planning Board reviewd a Short Environmental Assessment Form and passed a Negative Declaration citing input from the Waterkeeper as mitigating water quality issues. The Planning Board approved the application at their January 6, 2011 meeting with the following conditions: if noise or congestion is an issue, the applicant must come back to the Planning Board; install stormwater management (gutters, raingardens and pervious pavement) as per Waterkeeper comments; install privacy fence to the south; exterior lighting is to be downward facing and shielded; and applicant to pursue crosswal with NYSDOT.

Project Summary: The applicant proposes to remodel an existing single family home and construct a new driveway with erosion and stormwater controls at 231 Silver Bay Road (76.08-1-15&17). The project requires a variance for the installation of a stormwater infiltration device within 100 feet of a water supply. The project will include the construction of a new 12' wide circular paved driveway for the south side of the house and will require a 10 foot cut. A series of landscaped retaining walls are proposed for grading. The existing driveway to the garage on the north side of the house will be removed and replaced with blue stone tire tracks, reducing the impevious cover. A blue stone patio is proposed around the western and southern sides of the dwelling. A large rain garden is proposed on the east side of the existing dwelling to attempt to capture most of the house and new driveway runoff. Upland runoff as well as portions of the site runoff will be collected and bypass piped around the site to a culvert outlet neat the lake.
Waterkeeper Perspective: The Waterkeeper concerns included: the project should be designated as a major stormwater project within 500 feet of Lake George; Low Impact Development measures should be implemented to reduce the amount of impervious cover, grading and piping to increase infiltration; the existing onsite wastewater treatment system should be properly located and portions of the existing drainage from the house will not be directed to the rain garden.

Next Meeting: The Lake George Park Commission reviewed the variance apaplication at their December 21, 2010 meeting. The Commission granted the variance with the following conditions: 1) Plans are to be modified to include infiltration around the existing garage; and 2) The proposed grass swale will incorporate a perforated pipe to promote infiltration.

Project Summary: The applicant proposes to replace an existing single family dwelling which has a 112' shoreline setback with a new single family dwelling with a 50'-6" shoreline setback located at 36 Bobkat Lane (60.9-1-37). The property is located in the TR 1 Zoning District. The project will require a stormwater management permit from the Lake George Park Commission, which was determined to be a minor permit. The property is serviced by the Arcady Bay community septic system. The project will increase the number of bedrooms from 3 to 5. The Planning Board requested the current records be certified by an engineer and a report and flow records were submitted. The original treatment systeem was designed for 72 (3) & (4) bedroom houses and there are currently 69 lots, 4 of which are not connected to the system. The Planning Board questioned to tree removal and it was stated approximately 10 trees would be removed. The applicant obtained a LGPC stormwater permit and propsoed to install rain gardens in the stormwater basins closest to the lake.
Waterkeeper Perspective: The Waterkeeper concerns included: classifing the stoormwater plan as a major due to the steep slopes and proximity to the lake; concern about concerntrated runoff on steep grass swales and recommended erosion blanketting to prevent erosion; the removal of established vegetation on steep slopes and require a revegetation plant and the need to verfiy the wastewater flow at the existing treatment plant and the ability of the plant to accomodate 2 additional bedrooms.

Next Meeting: The Town of Hague Planning Board approved the Site Plan at their November 5, 2009 with conditions: 1) follow LGPC stormwater permit; 2) construct in compliance with septic permit; 3) enhance the lakeside buffer and 4) replace every tree moved upto a maximum of 10.

Project Summary: The applicant proposes to construct a 15' x 28' deck addition to an existing dwelling located at 69 Pine Cove Road (60.5-1-23). The parcel is located in the TR-1 Zoning District. The dwelling has a 89' shoreline setback. The applicant proposes to enclose an existing screened porch. The applicant has recently installed stormwater management and foundation drains around the existing house, which has resulted in exposed soils on steep slopes above the lake.
Waterkeeper Perspective: The Waterkeeper expressed concerns regarding the lack of erosion control on site for the stormwater management project and requested the installation of silt fence.

WILSON (UPDATED 5/11/11)
Project Summary: The applicant proposes a Major Subdivision of two parcels equaling 148.8 acres into 10 residential lots at the intersection of Summit Drive and Route 8 (25.1-1-17 & 18). The project is located in the OC1 Zoning District. The project will have a road off Summit Drive to access 8 lots and 2 lots will have driveway access to Route 8. The lots will be serviced by individual onsite wastewater treatment systems and by private wells. The project will require a major stormwater plan permit from the Lake George Park Commission. The subdivision has proposed a 200 foot no development buffer along a stream on the property.
Waterkeeper Perspective: The Waterkeeper has not provide public comment on the project. The Waterkeeper supports the implementation of Low Impact Development measures such as reduced width of road surfaces and combined driveway and the clustering of units. In addition, the Waterkeeper supports the proposed 200 foot buffer along the perennial stream. The Waterkeeper had questions about the possibility for additional combined driveways, who would be responsible for the maintenance of the stormwater management controls, could smaller stormwater controls be constructed closer to the source of the runoff, would there be any restrictions regarding the future subdivision of Lot 10 and would the individual lots be required to have site plan review.
Waterkeeper Comments: The Waterkeeper has not provided public comment on the application at this time. The Waterkeeper provided verbal comments at the April 7, 2011 public hearing held by the Town of Hague Planning Board. Next Meeting: The Town of Hague Planning Board reviewed the application at the December 4, 2010 Planning Board meeting and scheduled a public hearing for the January 6, 2011 Planning Board meeting. The public hearing was potponed at the applicants request to address outside qgency comments - The Lake George Park Commission submitted comments regarding the stormwater management system; NYSDEC stated an Individual SPDES permit was no longer required and NYSDOH has provided no response on the three raised wastewater treatment systems. At the February 3, 2011 Town of Hague Planning Board meeting, it was stated the NYSDOH signed off on the onsite wastewater treatment systems and the NYSDEC provided verbal comment that an individual SPDES permit would not be required. The Panning Board held a public hearing on April 7, 2011. The public hearing was held open pending the review of the project by the LGPC. The Planning Board requested the following additiona information: approval by the LGPC; future ownership of the road; future conditions; maintenance of the stormwater controls; and utility placement. The application was tabled until the May 5, 2011 meeting. The Hague Planning Board discussed possible conditions to the final plat at their May 5, 2011 meeting but were unable to take action pending approval from the Lake George Park Commission. The public hearing was held open.
